The Sussex House

General Notive

Tenant agrees that no contract is executed until and after tenant and Steve Dooling, Landlord have signed a written/email lease.

Payment

Tenant agrees that booking is not secure until signed contract, security deposit and 50% deposit are received by Steve Dooling. Balance is due on or before 30 days prior to check-in date. Any additional Security Deposit monies needed will be charged to credit card (below). Security will be charged for the amount to replace any damages. Additional cleaning deposit of $250 will be charged to same credit card if tenant does not return premises in a clean and good condition. All security monies will be returned after an inspection and property to be found in good and clean condition. Please make all checks payable to Steve Dooling.

Pets

NO PETS are allowed on or in the leased premises at ANYTIME. Should any pets be found on the premises, it will constitute an immediate breach of this contract and will require immediate vacating of the premises without any refund.

Occupancy

The maximum number of persons, including children, is limited to 15. Any number of persons above 15 in the premises will constitute a breach of this contract and will require immediate vacating of the premises.

Minors

Tenant affirms that he/she is at least 21 years of age. Tenant also affirms that the property will not be occupied by minors unless someone at least 21 years old is present.

Care

Tenant agrees to return premises to landlord, on expiration of this lease, in a clean and good condition as reasonable use will permit and to repair, replace or pay for any breakage or damage to the property, furnishings and equipment. Tenant is only responsible for breakage or damage done by tenant and/or his/her guests.

Smoking/Pets

For the safety and comfort of all our guests smoking is not permitted within the property. No pets are allowed.

Additions

No fixtures, appliance, furniture or air conditioning shall be installed or moved without the written consent of the landlord.

Visitation

The landlord or agent shall have access to the rented premises during the daylight hours to make repairs or to show for sale or rent.

Rentals

Tenant should make every effort to pre-inspect the property before executing this lease.

Repairs

Appliances, air conditioning, and amenities are not guaranteed and refunds will not be given due to breakdown. Repairs will be made by the landlord as soon as possible.

Amenities

Tenants shall furnish beach blankets and beach towels. Blankets, linens and towels IF provided by landlord are NOT for use on the beach. Bedding is not provided by landlord. Tenant will provide linens for six queen beds, one full pull-out sofa and one twin rollaway bed, as needed. If you are requesting linens and towels (FOR PRE AND POST SEASON RENTALS ONLY, tenant understands that there will be a $75 charge and additional charges will apply to replace any linens and towels which are missing or destroyed).

Rentability

If said leased premises is destroyed by fire or acts of God so as to be unfit for occupancy, either prior to or during the term of the lease, the landlord shall return an equitable prorated share of any rents that may have been paid in advance. The lease shall not terminate as a result of cosmetic defects or inoperable non-essential appliances.

Subletting

The Tenant shall not sublet the premises without written consent by the landlord.

Default

Any default by the tenant under the terms and conditions of this lease, including but not limited to unpaid rent, shall result in the termination of this lease and the premises must be vacated immediately with no refund to the tenant.

Cancellation

All requests by the Tenant to cancel this lease must be in writing to Steven Dooling and are subject to the property re-renting or acceptance by the owners. All deposit monies will be retained until the property is re-rented at full price. If the property is not re-rented in full, the difference will be due from the tenant and/or deducted from the deposit. Tenant agrees that all deposits and rental monies hall be held by the owners.

Acceptance

This lease must be signed and returned with the deposit within 7 days of the above date. Reservations cannot be guaranteed until deposit is received and lease is fully executed. This agreement is subject to the approval and acceptance of the landlord.

Counterparts

This contract may be executed in any number of counterparts, included counterparts transmitted by telecopier of FAX, and one of which shall constitute an Original of this contract. When counterparts or facsimile copies have been executed by all parties, they all have the same effect as if the signatures to each counterpart or copy were upon the same document and copies of such documents shall be deemed valid as originals. The parties agree that all such signatures may be transferred to a single document upon request of any party

Smoking

IS NOT PERMITTED in the premises, to include but not be limited to the enclosed porch and deck above. Should smoking be found in the premises or on the deck it will constitute a breach of this contract and require immediate vacating of the premises, loss of deposit money and no refund of any remaining rents. Burn marks or melted vinyl or PVC found will require the tenant to pay for the replacement of the damaged property.

Weather

The landlord can NOT guarantee the weather and will not refund any monies due to any weather conditions.

Notice

Steven Dooling is a licensed New Jersey Real Estate Broker. Landlord reserves the right to utilize the basement apartment and/or garage at any time. Tenants agree not to park ANY vehicle in driveway in front of garage as the City of Rehoboth Beach does not allow cars to be parked in a driveway in which a vehicle will extend onto the sidewalk.

Parking

Parking in the driveway is NOT permitted. The driveway is too short. Cars parked in the driveway will block the sidewalk. The city will ticket you. Do not attempt to parallel park in the driveway. You will cause damage to the lawn, fence and garage door. Parking in the driveway will constitute a breach of this contract.
